Terms of Service
1. Who we are
SettleIQ is operated by Cerdas Labs Sdn. Bhd., a company registered in Malaysia under company number 202601002615 (1664712-A), with its registered office at A-3-3, Plaza Bukit Jalil (Aurora Place), No. 1, Persiaran Jalil 1, Bandar Bukit Jalil, 57000 Kuala Lumpur, Wilayah Persekutuan, Malaysia. 2. How ordering works, and what it costs
Submitting the request form is not a purchase and takes no payment. It asks SettleIQ to assess whether a Buyer Folio can be produced for the address given, and to prepare one if so. SettleIQ confirms receipt by email, and — only once the folio is complete — sends a payment link. A contract to supply the folio to you is formed when that payment is made, not before.
The price of a Buyer Folio is a fixed £480, regardless of where you are billed from. For a UK buyer that breaks down as a £400 fee plus UK VAT at the standard rate of 20%; where a different tax treatment applies to your billing location, the balance between fee and tax may differ but the total you pay does not. There are no additional charges, and you are never charged more than the figure shown on the payment page before you confirm.
Our order process is conducted by our online reseller, Dodo Payments. Dodo Payments is the Merchant of Record for all orders placed through settleiq.co.uk — that is, Dodo Payments, not Cerdas Labs, is the legal seller of the Folio to you for payment purposes, and Dodo Payments handles payment processing, invoicing, tax collection and remittance, and any payment-related customer service enquiries, refunds, or chargebacks. Cerdas Labs never receives or stores your card details; payment is made on a page hosted by Dodo Payments, reached via the link we email you once your folio is ready.
3. What you are buying
A Buyer Folio is a commissioned research report on one residential address, assembled from public datasets and supplied for your own use in evaluating a prospective purchase.
It is delivered as a private web page hosted by SettleIQ, at a unique address we email you once payment is received. That address is unguessable and is excluded from search engines, but it is not password-protected: anyone you give the link to can read the folio. This is deliberate, so that you can pass it to your solicitor, broker, surveyor or the selling agent without friction. Treat the link as you would the report itself. Your folio stays available at that address for 12 months from delivery; if you need it after that, email us and we will restore access.
A Folio is supplied as digital content not on a tangible medium within the meaning of the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Clause 7 explains what that means for your right to cancel.
SettleIQ covers residential addresses in England only. The registers the methodology depends on are England-specific, and we do not produce Folios for addresses in Wales, Scotland or Northern Ireland. You may of course commission a Folio on an English address from anywhere. This service is available only to individuals aged 18 or over, purchasing in a personal capacity or on behalf of a business they are authorised to bind.
4. What a Folio is not
A Buyer Folio is not a RICS Red Book valuation, a mortgage valuation, a building survey, a structural or condition report, a legal opinion, or financial, investment or mortgage advice. SettleIQ is not regulated by the Financial Conduct Authority and is not a member firm of RICS. A Folio must be used alongside, and never instead of, a physical inspection by a suitably qualified surveyor and advice from your own solicitor and mortgage adviser.
5. Sufficiency
If, after widening geography and era as far as the methodology permits, fewer than five registered transactions of the same property type, tenure and new-build status exist for your address, no offer bracket can be produced. Because this is assessed before any payment link is sent, it carries no financial consequence for you: you are told what evidence does exist and why the threshold was not met, and are simply not asked to pay.
6. Delivery
Folios are ordinarily completed within two working days of your request being confirmed. Completion is what triggers the payment link; the link to your folio is emailed to you once payment clears, typically the same day. Where an address requires manual adjudication you will be told before that two-working-day deadline expires, not after it.
7. Your right to cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you would ordinarily have 14 days after entering a distance contract to cancel and receive a full refund. Regulation 37 of those Regulations provides that this right ceases to apply to a contract for the supply of digital content not on a tangible medium where, before supply begins, you have given express consent to supply beginning within the cancellation period and have acknowledged that you will lose your right to cancel as a result.
That is exactly the position here. A Buyer Folio is fully researched and complete before you are asked to pay, and is supplied to you immediately on payment, so there is no meaningful gap between contract formation and performance. Accordingly:
- By ticking the acknowledgement on the request form, you give your express consent to supply of the Folio beginning immediately once you pay, and acknowledge that you thereby lose your right to cancel under the Regulations once supply has begun. We record that consent, and the version of these terms in force when you gave it, against your request.
- The payment page restates that consent and acknowledgement beside the price before you confirm payment.
- We confirm the consent and acknowledgement back to you in writing by email, on a durable medium, together with the link to your Folio.
If the acknowledgement on the request form is not given, the order does not proceed and no payment is taken. None of this affects your right to a Folio that is as described, of satisfactory quality and fit for purpose — see clauses 8 and 9.
8. Refunds
Losing the right to cancel is not the same as losing the right to a refund. Your statutory remedies under the Consumer Rights Act 2015 for digital content that is faulty, not as described, or not delivered are unaffected by clause 7, and cannot be excluded.
Our Refund Policy sets out in full when a refund is due, how to ask for one, and how long it takes. In short: if your Folio does not conform to what was ordered, email team@settleiq.co.uk within 14 days of delivery describing the problem. We will investigate and, where a repair or replacement is not possible or does not fix it, arrange a full or partial refund through Dodo Payments as Merchant of Record.
9. Accuracy and limitation of liability
Public datasets contain errors and omissions outside our control. A Folio reports what the registered record shows at the stated extraction date. Decisions about what to offer, what to borrow and what to sign remain yours.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Subject to that, our total liability to you arising out of or in connection with a Buyer Folio, whether in contract, tort (including negligence) or otherwise, is limited to the total amount you paid for that Folio, and we are not liable for indirect or consequential losses, including any change in a property's value, any overpayment on a purchase, or any failed or delayed transaction. This does not affect your statutory rights under the Consumer Rights Act 2015, including the right to digital content of satisfactory quality, fit for purpose and as described, and to a service performed with reasonable care and skill.
10. Intellectual property and use
The Folio is licensed to you for use in your own transaction, including sharing it with your solicitor, broker, surveyor and the selling agent. It may not be resold, republished or used as the basis of a competing product.
11. Complaints and dispute resolution
If something goes wrong, email team@settleiq.co.uk and we will investigate directly. Where a complaint concerns payment, invoicing or a refund, you may also raise it with Dodo Payments as Merchant of Record.
SettleIQ does not currently subscribe to, and does not agree to use, an Alternative Dispute Resolution (ADR) scheme. We are not obliged to. If a complaint cannot be resolved directly with us, you may take it to a certified ADR provider — the Chartered Trading Standards Institute publishes the list of approved bodies at tradingstandards.uk — but we would not be bound to take part. You also retain the right to pursue the matter through the courts, as set out in clause 13.
12. Changes to these terms
We may update these terms from time to time, for example to reflect a change in our methodology, our suppliers, or the law. The version in force at the time you submit a request form is the version that applies to that order, and we keep a dated copy of each version so that it can be produced on request. Material changes will be reflected in the "last updated" date above.
13. Governing law and jurisdiction
Although Cerdas Labs Sdn. Bhd. is incorporated in Malaysia, these terms, and any dispute or claim arising out of or in connection with them, are governed by the law of England and Wales. A business incorporated outside the UK may validly choose English law to govern its consumer contracts; where you are a UK consumer, mandatory UK consumer-protection rules apply regardless of that choice.
Claims may be brought in the courts of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you may instead bring proceedings in the courts of the part of the United Kingdom in which you live, and nothing in these terms restricts that. We will bring any claim against a consumer only in the courts of the part of the United Kingdom in which that consumer lives.
